AGF Yet to Act on NCAA Petition Against KWAM 1 One Week Later

One week after Fuji music legend Wasiu Ayinde, popularly known as KWAM 1, was involved in a mid-air incident aboard a ValueJet flight, the Attorney-General of the Federation (AGF) has yet to initiate prosecution, despite a formal petition from the Nigerian Civil Aviation Authority (NCAA).

On August 5, Ayinde allegedly refused to surrender a flask suspected to contain alcohol — prohibited onboard aircraft in Nigeria — claiming it was “medication prescribed by his doctor.” Following the altercation, he was deboarded but later attempted to prevent the aircraft from taking off, with videos showing him in a heated exchange with airport staff.

Michael Achimugu, NCAA’s director of public affairs and consumer protection, said the authority has petitioned the AGF and the inspector-general of police (IGP) for “a comprehensive criminal investigation and the initiation of appropriate prosecution of the musician following the provisions of the Nigeria Civil Aviation regulations (Nig. CARs) 2023 supra and all other applicable laws.”

Checks by TheCable show KWAM 1 violated Parts 15, 17 and 20 of the Nigeria Civil Aviation Regulations 2023. The NCAA has since placed him on a no-fly list and suspended two ValueJet pilots over safety protocol breaches, warning that his actions “amount to an act of terrorism in some other countries.”

Unlike Comfort Emmanson, an Ibom Air passenger arraigned within 24 hours of her August 10 onboard assault, there has been no court date for Ayinde. The AGF’s office has not responded to inquiries, leaving the question of when — or if — prosecution will begin unanswered.
