Kanu Wants Case Moved to Southeast if No Judge Takes Over Nyako

The detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, has called for his trial to be moved to the Southeast if no other judge at the Federal High Court in Abuja is willing to preside over his case apart from Justice Binta Nyako.

This request was conveyed by Kanu’s lead counsel, Aloy Ejimakor, in a statement following a meeting with Kanu at the Department of State Services (DSS) facility in Abuja.

Kanu’s demand comes after Justice Nyako recused herself on September 24, 2024, citing the IPOB leader’s expressed lack of confidence in her handling of the trial. Despite her withdrawal, the case was referred back to her by the Chief Judge of the Federal High Court, Justice John Tsoho.

Reacting to this development, Kanu, through his counsel, insisted that the resumption of his trial by Justice Nyako undermines judicial credibility.

Ejimakor said, “Onyendu instructed the legal team to take prompt steps to ensure that his case is not handled by the same Justice Binta Murtala-Nyako, who had withdrawn from the case by virtue of the order of recusal entered on 24th September 2024.”

The statement further stressed the need for judicial consistency, warning that “should the case still lie with Justice Murtala-Nyako, it would mean that the same court is disobeying an order that it made.”

Kanu’s legal team also emphasized the importance of relocating the trial to the Southeast if no Abuja judge is available.

“If no other judge in Abuja is willing to handle the case, the Chief Judge is free to transfer the case to Umuahia, Awka, Enugu, Asaba, Port Harcourt, or any other Federal High Court within the former Eastern Nigeria,” the statement concluded.
